Under authority of the powers of sale and conveyance contained in that certain Deed to Secure Debt given by JERRY HOWARD to SOUTH GEORGIA BANK, dated August 5, 2011, the same being recorded in Deed Book 479, Pages 661-666, Appling County Records, conveying the after-described property to secure a Note dated August 5, 2011 and executed by JERRY HOWARD, in the original principal amount of TWENTY FIVE THOUSAND DOLLARS AND NO/100 DOLLARS ($25,000.00), with interest thereon as set forth therein, there will be sold on the first Tuesday in December, 2021, within the legal hours of sale, before the Courthouse door in Baxley, Appling County, Georgia, at public outcry to the highest bidder for cash, the land conveyed in said security deed and note described as follows:

All that certain lot or parcel of land lying, situate and being in Land Lot No. 335, 2nd Land District, Appling County, Georgia, containing 1.00 acres, more or less, and being bounded, now or formerly, as follows: North, East and West by lands of Jerry Howard; and South by the Old Baxley-Surrency Road. Said lot is more fully shown upon a plat of survey prepared by Joe P. Davis, Surveyor, dated July 1, 2011, recorded in Plat Book 19, page 479, Appling County, Georgia Records, specific reference to which is made a part of this description.

Also: the right to receive water service for household and domestic purposes from the well located upon the adjacent and adjoining lot of Jerry Howard.

Also: One 1998 Bellcrest Mobile Home, 14’x70’, VIN # GBHML51750, located upon, permanently attached to and made a part of the real estate.

This is the same property received by Jerry Howard by Quitclaim Deed dated August 5, 2011 from Johnny Howard, Clinis J. Howard, Stanford R. Howard and Tammy Howard, recorded in the office of the Clerk of Superior Court of Appling County, Georgia, in Deed Book 479, Page 660.

Said property being known as: 691 Old Surrency Road, Baxley, Georgia 31615.

The indebtedness secured by said Deed to Secure Debt has become in default as to principal and interest because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed and the whole amount of said indebtedness is declared to be in default and immediately due and payable, and the above-described property will be sold for the purpose of enforcing payment of the indebtedness secured by said Deed to Secure Debt. A deed will be executed to the purchaser at said sale conveying title as authorized in said Deed to Secure Debt.

The proceeds of said sale will first be applied to the payment of the indebtedness to South Georgia Bank, other charges and the expenses of sale as provided in said Deed to Secure Debt, including attorney’s fees (notice of intent to collect attorney’s fees having been given) and the excess, if any, as provided by law. Said sale and the deed made to the purchaser at said sale will be subject to any outstanding unpaid ad valorem taxes on said property (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.

To the best knowledge and belief of the undersigned, the party in possession of the property is Jerry Howard, or a tenant or tenants.

Notice of Public Hearing

Notice is hereby given that a Public Hearing will be held on January 12, 2022 at 10:00 AM for comment on the Baxley Housing Authority’s FY2022- FY2026 Capital Fund Five-Year Action Plan as required by the U.S. Department of Housing and Urban Development. The FY2022 – FY2026 Capital Fund Five-Year Action Plan will be available for review over the next 45 days at the Authority’s central office located at: 94 Highland Drive, Baxley, Ga 31513-0339.

The Public Hearing will also be held at this location. Any person wishing to comment on the above document may file his or her comments in writing with the Executive Director of the Housing Authority at the above address by 5:00 PM on January 11, 2022 or may attend the Public Hearing. All comments will be considered in preparing the final documents before submittal to the U.S. Department of Housing and Urban Development.
