YOU ARE HEREBY NOTIFIED that on the 20th day of June, 2011, at 10:00 a.m., at 305 West Parker Street, Baxley, Georgia, a public hearing will be held before a designated hearing officer with respect to the proposed plan of financing involving the issuance from time to time in one or more series of not to exceed $70,000,000 aggregate principal amount outstanding at any one time by the Development Authority of Appling County (the “Issuer”) for the benefit of Georgia Power Company (“Georgia Power”) (in addition to any other obligations previously issued to finance or refinance the Facilities hereinafter referred to or any obligations issued by the Issuer or Georgia Power to refund such obligations) of its pollution control revenue obligations (the “Bonds”), the proceeds of which are to be used (i) to finance or refinance, in whole or in part, the costs of the acquisition, construction and installation of additions, extensions and improvements to the undivided interest of Georgia Power in certain generating facilities, air or water pollution control facilities and sewage or solid waste disposal facilities, such facilities to consist of certain land, buildings, structures, machinery, equipment and related real and personal property (the “Facilities”) at the Hatch Nuclear Generating Plant located on the Altamaha River, just off U.S. Highway 1, approximately 12 miles north of Baxley, Georgia, in Appling County, Georgia, or (ii) to refund bonds previously issued by the Issuer for such purpose. An initial owner, operator or manager of the Facilities is Georgia Power.
The Bonds will not constitute an indebtedness or obligation of the State of Georgia or of any political subdivision thereof, but will be payable solely from the revenues derived from Georgia Power and pledged to the payment thereof.
Any person interested in the proposed issuance of the Bonds pursuant to the plan of financing or the location or the nature of the Facilities proposed to be financed or refinanced from the proceeds of the sale of the Bonds may appear and be heard.
The Issuer will not conduct any performance audit or performance review with respect to the Bonds as such terms are described in Section 36-82-100, Official Code of Georgia Annotated.
