By virtue of the power of sale contained in that certain Deed to Secure Debt from Troy L. Barney, Sr. to Altamaha Bank & Trust Company filed for record, and recorded in Deed Book 422, Pages 5-9, Appling County, Georgia Records, said Deed to Secure Debt having been given to secure a Note dated September 15, 2006, and said note or the renewal thereof now being in default there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door in Baxley, Appling County, Georgia, within the legal hours of sale on the first Tuesday in June, 2011, the property described as:
All that tract or parcel of land lying, being and situated in Land Lot No. 341 of the 2nd Land District of Appling County, Georgia, consisting of 0.511 acre, and being designated as Tract 1 on that certain survey and plat thereof entitled “Survey for Montene H. Morris Estate” prepared by M. Jerry Tomberlin, Jr., G.R.L.S. No. 2942, dated March 2, 2006, recorded in Plat Book 18, Page 238, of the records of the Clerk of Superior Court of Appling County, Georgia, said plat by this reference hereto being incorporated herein and made a part hereof for all necessary purposes. Said tract is bounded, now or formerly, as follows: North by Tract 2 of the above referenced survey; East by lands of Josephine Williams; South by the Northern right-of-way of Middlewood Drive; and West by the Eastern right-of-way of M.L.K. Avenue.
The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments and lack of insurance on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees.
A copy of this legal advertisement (Notice of Sale Under Power) which was sent to the Baxley News Banner has been mailed by certified mail, return receipt requested to Troy L. Barney, Sr. if required by Georgia Law, O.C.G.A. 44-14-162.2 and 44-14-162.3.
Said property will be sold as the property of Troy L. Barney, Sr. subject to any and all unpaid taxes, assessments, general subdivision restrictions, if any, and other restrictions and easements of record, if any; and to the best knowledge and belief of the undersigned, Troy L. Barney, Sr. is in possession of said property.
The proceeds of the sale will be used as follows: (a) To pay the expense of said sale; (b) To pay the sum secured by said deed; c) The balance to as provided by law.
This law firm is attempting to collect the debt described above, and any information obtained will be used for that purpose.
