Under and by virtue of the power of sale and in accordance with the terms of a certain Deed to Secure Debt from BILLY ALTMAN, JEFFERY ALTMAN AND MITCHELL ALTMAN, Grantor, to First National Bank n/k/a FNB SOUTH, Grantee, dated April 9, 2007; recorded in Deed Book 429, Page 490-496, APPLING County, Georgia records; there will be sold by the undersigned at public outcry, during the legal hours of sale, before the Courthouse door in APPLING County, Georgia, on the first Tuesday in April, 2011, to the highest bidder for cash, the following described property:
All that tract or parcel of land lying and being in the Second Land District of Appling County, Georgia, consisting of 90 acres, more or less, of Lot of Land No. 151, being bound: North by lands of John Altman, and lands of Mrs. Ardelia Crosby; East by lands of John J. Altman, Jr.; South by lands of Evans Altman, the run of a branch being the line, and West by lands of Mrs. Ardelia Crosby. This being known as the Lem Altman place, and being all of the land owned by the said Lem Altman in said lot at the time of his death. Said tract of land includes the 75 acre tract conveyed from Elizabeth Altman to Lemuel Altman by deed dated February 2, 1917 recorded in Deed Book 16, page 159, and the 15 acre tract conveyed to him by Noah Altman by Deed dated February 17, 1919, recorded in Deed Book 16, page 25, of Deed records of Appling County, Georgia.
The debt secured by said Deed to Secure Debt and any renewal thereof has been and is hereby declared due and payable in full because of default pursuant to the terms of said debt and the Deed to Secure Debt securing same. Notice has been given of intention to enforce collection of attorney's fees and foreclosure in accordance with the terms of the debt, the Deed to Secure Debt, and as provided by law.
The person that has full authority to negotiate, amend, and modify all the terms of the Deed to Secure Debt with the Debtor is Angie Carter, FNB South, 198 W Parker St, Baxley, GA 31513, 912-367-0200. Please understand that the secured creditor is not required by law to negotiate, mend, or modify the terms of the Deed to Secure Debt or Note. Terms: Cash. Purchaser to pay for title, State of Georgia real estate transfer tax and all taxes that may be due on said real property. Sale is subject to restrictions and easements of record.
