Because of default in payment of the indebtedness secured by the note and security deed and under and by virtue of the power of sale contained in Deed to Secure Debt dated July 28, 2005, from Ronnie L. Carter to Peoples State Bank & Trust, filed for record on August 3, 2005, and recorded in Deed Book 406, Page 269, in the office of the Clerk of Superior Court of Appling County, Georgia, conveying the after described property to secure a Note in the original principle amount of $27,812.32, with interest thereon as set forth therein, the undersigned will sell at public outcry during the legal hours of sale before the door of the courthouse in Appling County, Georgia on July 3, 2012, the first Tuesday in July, 2012, to the highest bidder for cash, the following described real property:
Beginning at the point where the centerline of that certain road known as Beach Road intersects the centerline of that certain lane known as Donnie Lane in Land Lot 331 of the Second Land District of Appling County, Georgia, and thence from said point North 90 degrees West a distance of 226 feet to a point; this being the point and place of beginning of the within conveyed tract of land; thence North 90 degrees West a distance of 599 feet to a point; thence North 01 degree 24 minutes East a distance of 325 feet to a point; thence South 90 degrees East a distance of 795 feet to a point; thence South 01 degrees 24 minutes West a distance of 25 feet to a point; thence North 90 degrees West a distance of 196 feet to a point; thence South 01 degrees 24 minutes West a distance of 300 feet to a point; this point being the point or place of beginning of the tract herein conveyed.
For a more complete description reference is hereby made to that plat dated 9/8/73 and recorded in Plat Book 11, Page 74 of the public land records of Appling County, Georgia.
The debt secured by said Deed to Secure Debt and evidenced by said Note has been and is hereby declared due and payable because of grantors failure to comply with certain terms and conditions in said Deed to Secure Debt, including but not limited to nonpayment of the indebtedness as and when due. The debt remaining in default, this sale will be made for the purpose of paying said indebtedness, including all accrued and unpaid interest thereon and attorney fees and all expenses of said sale as provided for under the terms of the security deed and notes.
Notice has been given of intention to enforce provisions for collections of attorney fees and foreclosure in accordance with legal requirements and the terms of said Deed to Secure Debt and Note.
To the best of the undersigned's knowledge and belief, the party in possession of the property is Ronnie L. Carter, Ronnie L. Carter Estate or a tenant or tenants and said property is more commonly known as 274 Beach Road, Baxley, Georgia 31513.
Said property will be sold subject to any and all unpaid ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens and encumbrances, general subdivision restrictions, if any, and other restrictions, covenants and easements of record, if any and matters of record superior to the Security Deed first set out above.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
