By virtue of Power of Sale contained in Deed to Secure Debt from LOUIS J. WILLIAMS, hereinafter GRANTOR, in favor of AMERICAN GENERAL FINANCIAL SERVICES, INC., N/K/A SPRINGLEAF FINANCIAL SERVICES, INC., dated the 17th day of August, 2007, and filed for record the 21st day of August, 2007, in Deed Book 435, Page 161, Appling County, Georgia Records; said Deed to Secure Debt being given to secure a Promissory Note of even date in the original principal amount of Fifty Four Thousand Two Hundred Thirteen and 50/100ths Dollars ($54,213.50), with interest from date as stated therein; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at APPLING County, Georgia, within the legal hours of sale on the first Tuesday in APRIL, 2012, the following described property:
All that tract or parcel of land lying and being in Land Lot No. 349 of the Second Land District of Appling County, Georgia, consisting of 1.98 acres, more or less, and being described as Tract Eleven (11), according to that certain plat of survey prepared by Merlin L. Tomberlin, GRLS No. 2477, dated December 27, 1994, recorded in Plat Book 13, Page 409, in the Office of the Clerk of Superior Court of Appling County, Georgia, and incorporated herein for all purposes.
Provided however, this conveyance is made subject to the restrictive covenants contained in the deed from Jon Lott and Zachary Morris Johnson to R.L. Branch and Theresa A. Branch dated May 14, 1996, recorded in the aforesaid Clerk’s office in Deed Book 293, Page 414.
This is the same property conveyed by Warranty Deed from Glenn Crummey to Louis J. Williams, dated 4/22/2005, recorded 4/26/2005, in Deed Book 402, Page 798, Appling County, Georgia Records.
The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees. Said property will be sold subject to any outstanding ad valorem taxes, special assessments, unpaid utility bills constituting liens against the property, and all Deeds to Secure Debt, liens and encumbrances existing when the above-described Deed to Secure Debt was filed for record. To the best of the undersigned's knowledge, information and belief, equitable title to this property is held by LOUIS J. WILLIAMS. This property is located at 968 Max Deen Drive, Baxley, GA 31513.
