Under and by virtue of the power of sale and in accordance with the terms of a certain Deed to Secure Debt from THOMAS KIP DAVIS, Grantor, to First National Bank n/k/a FNB SOUTH, Grantee, dated July 16, 2003; recorded in Deed Book 377, Page 588-594, APPLING County, Georgia records; there will be sold by the undersigned at public outcry, during the legal hours of sale, before the Courthouse door in APPLING County, Georgia, on the first Tuesday in December, 2011, to the highest bidder for cash, the following described property:
All that tract or parcel of land lying and being in Land Lot No. 486 of the Third Land District of Appling County, Georgia, consisting of 33.192 acres, more or less, being more particularly described as Tract B on that certain plat of survey by Denean W. Dixon, GRLA #1647, dated December 22, 1990, which plat is recorded in the Office of the Clerk of Superior Court of Appling County, Georgia, in Plat Book 13, page 290, and incorporated herein for a more full and complete description and all other purposes.
This property being compromised of two tracts of land conveyed to Grantor herein by:(a) Deed from Mrs. J. E. Youmans dated May 5, 1990, recorded in Deed Book 246, Page 833, Appling County Records; and(b)Deed from Eugene Youmans and Charles P. Youmans dated August, 1991, Recorded in Deed Book 255, page 471, Appling County records.
The debt secured by said Deed to Secure Debt and any renewal thereof has been and is hereby declared due and payable in full because of default pursuant to the terms of said debt and the Deed to Secure Debt securing same.Notice has been given of intention to enforce collection of attorney's fees and foreclosure in accordance with the terms of the debt, the Deed to Secure Debt, and as provided by law.
