WHEREAS, there has been a default in the payment of the indebtedness secured by that certain Deed to Secure Debt dated October 6, 2008, signed by James Adam Jones and Kimbry Smith and made to Taylor Repo, Inc. recorded in Record Book 451, pages 67-68, in the Office of the Clerk of Superior Court of Appling County, Georgia; and
WHEREAS, to the best knowledge of Taylor Repo, Inc., Kimbry Smith is currently in possession or control of the property described below, and
WHEREAS, under the provisions of said Deed to Secure Debt said indebtedness secured thereby has immediately become due and payable and remains in default;
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That pursuant to the terms of the Deed to Secure Debt, and the power of sale contained therein and the laws in such cases made and provided after proper advertisement, the undersigned on the first Tuesday in November, to wit: November, 1, 2011, before the Courthouse door in Appling County, Georgia, between the legal hours of sale, will expose for sale to the highest and best bidder for cash the following described property, to wit:
All that tract or parcel of land lying and being in the Third District of Appling County, Georgia, consisting of 1.37 acres, more or less, of Original Land Lot No. 217, and bound as follows: North by Tract No. 8, as shown on the hereinafter referred to plat, being property this day conveyed to Jerry Jones; East by Tract No. 5, as shown on said plat, being property this day conveyed to Jursha Lee Jones, South by Tract No. 7, as shown on said plat, being property this day conveyed to Nathaniel Jones, Northwesterly by lands of Union Camp Corporation.
This above described property being designated as Tract 6, on a survey and plat thereof by Merlin J. Tomberlin, County Surveyor, dated November 20, 1979, and a copy of same being of record in the Office, Clerk of Superior Court, Appling County, Georgia, Plat Book 10, page 50.
This is the same property as that conveyed from Essie Lee Alderman as Executrix u/w Equilla Jones to James Adam Jones by deed dated June 4, 1980, and recorded in Deed Book 191, Page 212, in the Public Land Records of Appling County, Georgia.
TERMS: Cash; purchaser paying Georgia transfer tax and all ad valorem taxes and assessments that may be due on said property; the property shall be sold AS IS, WHERE IS and the sale shall be subject to all superior liens, easements and restrictions of record, if any, and the right of redemption of any taxing authority; the proceeds of this sale shall be applied to pay the secured debt as provided in the Deed to Secure Debt together with the expenses of this sale, including attorney's fees.
