By virtue of the power of sale contained in a Deed to Secure Debt by James O. Fletcher and Janie Fletcher to Travelers Bank & Trust, FSB, dated January 20, 1999 and filed for record January 26, 1999 in Deed Book 321, Page 558, Appling County, Georgia records, and securing a Note in the original principal amount of $26,756.20, there will be sold at a public outcry for cash to the highest bidder before the Courthouse door of Appling County, Georgia, between the legal hours of sale on the first Tuesday in November, 2011, by CitiCorp Trust Bank, FSB formerly known as Travelers Bank & Trust, FSB as Attorney-in-Fact for James O. Fletcher and Janie Fletcher the following property to-wit:
ALL THAT PARCEL of land in Second Land District, Appling County, State of Georgia, consisting of (1) acre of Lot of Land No. 370 and being bound now or formerly as follows:
North by a graded road; east and south by lands of Clara Fletcher; and west by lands of Pauline Phillips, said lands being accurately described according to a survey and plat thereof by Olin J. Baxley, County Surveyor, dated January 5, 1959, said plat being of record in the Office of the Clerk of Superior Court, Appling County, Georgia, in Plat Book 3, Page 370, reference being made to said plat for all purposes.
The above-described property is also known as 1312 Fletcher Road, Baxley, GA 31513.
The indebtedness secured by said Deed to Secure Debt having been declared due and payable because of default in the payment of the indebtedness secured thereby, this sale will be made for the purpose of paying the same and all expenses of sale, including attorney's fees, if applicable.
The property will be sold as the property of the aforesaid grantor subject to the following: all prior restrictive covenants, easements, rights-of-way, security deeds, or encumbrances of record; all valid zoning ordinances;?matters which would be disclosed by an accurate survey of the property or by any inspection of the property; all outstanding taxes, assessments, unpaid bills, charges, and expenses that are a lien against the property whether due and payable or not yet due and payable.
To the best of the undersigned's knowledge and belief, possession of the subject property is held by Janie Fletcher and James O. Fletcher.
