Under and by virtue of the power of sale contained in that certain deed to secure debt dated August 26, 2008, from SAMUEL CLAY BEASLEY to SOUTH GEORGIA BANK filed for record on August 28, 2008, and recorded in Deed Book 449, Page 750, in the office of the Clerk of the Superior Court of Appling County, Georgia, the undersigned will sell at public outcry during the legal hours of sale before the door of the courthouse in Appling County, Georgia, on the first Tuesday in September, 2011, to the highest bidder for cash, the following described real property:
All that certain tract or parcel of land, together with improvements thereon, lying, situate and being in Land Lot 530, Second Land District, Appling County Georgia, containing 8.957 acres, more or less, and being shown and designated as Tract 1 upon a plat of survey prepared by M. Jerry Tomberlin, Jr., Surveyor, dated February 29, 2008, recorded in Plat Book 19, Page 86, Appling County, Georgia Records, specific reference to which is made a part of this description.
Also:
One 1997 Mobile Home, Model Southern, Vin # HMST12011ABGA, located upon, permanently attached to and made a part of the real estate.
Together with all fixtures and personal property attached to and constituting a part of said real estate, including a 4 ton Grandaire air conditioner, Serial No.GPF070500541, Model No. GP3RD-048K, and all other personal property described in that certain UCC Statement, filed for record on August 29, 2008, as file number 001-2008-6647, records of the Clerk of the Superior Court of Appling County, Georgia.
The debt secured by said deed to secure debt is evidenced by a promissory note dated August 26, 2008, in the original principal amount of FIFTY THREE THOUSAND EIGHT HUNDRED TWENTY FOUR AND 99/100 ($53,824.99) DOLLARS, with interest thereon as set forth in said note, executed by SAMUEL CLAY BEASLEY in favor of South Georgia Bank.
The debt secured by said security deed has been and is hereby declared due and payable because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the note and security deed. The debt remaining in default, this sale will be made for the purpose of paying the indebtedness, including all accrued and unpaid interest thereon, and all expenses of this sale, as provided in the security deed and by law, including attorney's fees (notice to collect attorney's fees having been given in accordance with legal requirements and the terms of the security deed and note).
The property will be sold as the property of SAMUEL CLAY BEASLEY who, to the best of the undersigned’s knowledge and belief, is the party in possession of said property.
The entity that has full authority to negotiate, amend, and modify all terms of the deed to secure debt and note with the debtor is: South Georgia Bank, Post Office Box 100, 401 South Main Street, Glennville, Georgia 30427, (912) 654-1051. Please understand that the secured creditor is not required by law to negotiate, amend or modify the terms of the deed to secure debt.
Said property will be sold subject to the following items which may affect the title to said property: all zoning ordinances; any outstanding taxes, including, but not limited to, ad valorem taxes which constitute liens upon said property (also including taxes which are a lien whether or not now due or payable); all matters which would be disclosed by an accurate survey or by an inspection of the property; any assessments, liens, easements, rights of ways, encumbrances, restrictions, covenants, matters of record superior to the deed to secure debt first set out above and any right of redemption held by any governmental entity under law.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) final confirmation and audit of the status of the loan with the holder of the security deed.
