CREECH, Grantor, to First National Bank n/k/a FNB SOUTH, Grantee, dated May 29, 2003; recorded in Deed Book 375, Page 278-284, APPLING County, Georgia records; there will be sold by the undersigned at public outcry, during the legal hours of sale, before the Courthouse door in APPLING County, Georgia, on the first Tuesday in September, 2011, to the highest bidder for cash, the following described property:
All that tract or parcel of land lying and being in Land Lot No. 293 of the Second Land District, Appling County, Georgia, being in the City of Baxley, consisting of 1.14 acres, more or less, and being more particularly described as follows: BEGINNING at the intersection of the easterly right of way of Holmesville Ave. (40’ ROW) with the northerly right of way of Walnut Street (40’ ROW), thence continuing along said Walnut Street right of way North 75 degrees 45 minutes 00 seconds East 287.19 feet to a point; thence South 13 degrees 42 minutes 28 seconds East 103.48 feet to a point; thence South 75 degrees 36 minutes 00 seconds West 48.32 feet to a point; thence South 13 degrees 09 minutes 09 seconds East 100.00 feet to a point; thence south 76 degrees 10 minutes 30 seconds West 88.87 feet to a point; thence North 11 degrees 43 minutes 09 seconds West 26.03 feet to a point; thence South 75 degrees 16 minutes 01 seconds West 150.91 feet to a point located on the Easterly right of way of Holmesville Ave; thence along and with said Holmesville Ave. right of way North 13 degrees 23 minutes 51 seconds West 178.21 feet to the Point of Beginning.
For a more particular description reference is hereby made to a survey and plat thereof prepared by Merlin J. Tomberlin & Associates, certified by Merlin J. Tomberlin, GRLS No. 2477, dated March 20, 1998, recorded in Plat Book 14, page 420, in the Office of the Clerk of Superior Court of Appling County, Georgia, incorporated herein for all purposes.
The debt secured by said Deed to Secure Debt and any renewal thereof has been and is hereby declared due and payable in full because of default pursuant to the terms of said debt and the Deed to Secure Debt securing same. Notice has been given of intention to enforce collection of attorney's fees and foreclosure in accordance with the terms of the debt, the Deed to Secure Debt, and as provided by law.
The person that has full authority to negotiate, amend, and modify all the terms of the Deed to Secure Debt with the Debtor is Darnell Stone, FNB South, 198 W Parker St, Baxley, GA 31513, 912-367-0200. Please understand that the secured creditor is not required by law to negotiate, amend, or modify the terms of the Deed to Secure Debt or Note.
