On August 10, 2010, SANDRA C. SAPP executed a Note in the original principal amount of $588,886.48, payable to PEOPLES STATE BANK & TRUST. Time was made the essence of the contract and the Note contained a provision for the payment of attorney’s fees if collected by law or through an attorney at law. In order to secure the payment of said Note, the said SANDRA C. SAPP executed and delivered to PEOPLES STATE BANK & TRUST a Deed to Secure Debt, recorded in Deed Book 422, Page 569, AND RE-RECORDED IN Deed Book 426, page 767, in the Office of the Clerk of the Superior Court of Appling County, Georgia, conveying the following described property:
All that tract or parcel of land lying and being in the Second Land District of the City of Baxley, Appling County, Georgia consisting of .48 acres, more or less, of Land Lot No. 332 being more particularly described according to the courses, metes and bounds of Parcels A and B of that certain survey and plat thereof by R. Bayne Stone, GRLS #2440, dated 6/20/2006, recorded at Plat Book 18, Page 289, Appling County, Georgia Deed Records, which is incorporated herein and made a part hereof for descriptive and all other legal purposes.

Because the said SANDRA C. SAPP defaulted in making payment of said Note, Peoples State Bank & Trust, pursuant to the provisions of said Note and the aforesaid Deed securing the same, has exercised its option and declared the entire balance due and collectible. Notice fixing the liability for attorney’s fees has been given according to the law.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, leases, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. Pursuant to O.C.G.A. §44-14-162.2 the name of the person or entity having the full authority to discuss negotiation, amendment or modification of the terms of the aforementioned indebtedness is: Peoples State Bank & Trust, Attn: Kathy Mayers, 72 East Parker Street, Baxley, Georgia 31513, Telephone: (912) 367-3658.
The property will be sold as the property of Sandra C. Sapp who, to the best of the undersigned’s knowledge and belief, is the party in possession.
The said Deed contains a power of sale, authorizing the Grantee, as attorney in fact for Grantor therein, to sell the property conveyed thereby in order to satisfy said Note, as well as subsequent advances, after advertising the same once a week for four (4) weeks in the official gazette of said County, and in accordance with said power of sale and by virtue thereof, Peoples State Bank & Trust will sell the property above described at public outcry to the highest and best bidder for cash, on the first Tuesday in June at the place of public sales before the Courthouse door in Appling County, Georgia, and within the legal hours of sale.
The proceeds of the sale will be used as follows: (a) to pay the expenses of said sale; (b) to pay the sums secured by said Deed; and (c) the balance according to law.
