Under and by virtue of the Power of Sale contained in a Security Deed given by Richard W. Leigh to SunTrust Bank, Southeast Georgia, N.A., dated August 16, 1999, and recorded in Deed Book 328, Page 317, Appling County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of Fifty Thousand and 0/100 dollars ($50,000.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Appling County, Georgia, within the legal hours of sale on September 2, 2014, the following described property:
All that certain tract of parcel or land situate, lying and being in Land Lot No. 382 of the Second Land District of Appling County, Georgia, and being described as follows: Beginning at an iron pin on the West right of way of Pitty Pat Lane, this iron pin being 300 feet from the West right of way intersection of Pitty Pat Lane with the Southern right of way intersection of Lake Tara Road; thence running South 05 degrees 39 minutes East along the western right of way of Pitty Pat Lane a distance of 150 feet; thence running South 89 degrees 50 minutes West for a distance of 179.55 feet; thence running North 04 degrees 54 minutes West for a distance of 150 feet; thence running North 89 degrees 50 minutes East for a distance of 176.09 feet to the Point of Beginning. Said property being bounded, now of formerly, on the North by Lands of Morris Industries, Inc.; on the East by Pity Pat Lane; and on the South and West by Lands of Morris Industries, Inc.
This being the same property conveyed from E. C. McLaurin and Lynn McLaurin to Billy Head by Warranty Deed dated March 30, 1999, recorded in Deed Book 324, Page 173, in the Office of the Clerk of Superior Court of Appling County, Georgia.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given).

To the best knowledge and belief of the undersigned, the party in possession of the property is Richard W. Leigh or tenant(s); and said property is more commonly known as 80 Pitty Pat Lane, Baxley, GA 31513.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) final confirmation and audit of the status of the loan with the holder of the security deed and (3) any right of redemption or other lien not extinguished by foreclosure.
