LINDSEY to FNB SOUTH, N.A., dated January 29, 2004 recorded in Deed Book 386 page 254-260, Clerk(s Office, Appling County, Georgia, there will be sold by the undersigned at public outcry to the highest bidder for cash before the courthouse door at Appling County, Georgia, within the legal hours of sale on the first Tuesday in January, 2014, the following described property:
All that tract or parcel of land lying and being in Land Lot No. 340 of the Second Land District of Appling County, Georgia, being more particularly described as follows: Beginning at a point on the East right of way of the Ben Carter Highway, said point being the East right of way intersection of Ben Carter Highway as it intersects with Southwoods Drive; thence running from POINT OF BEGINNING South 88 degrees 10 minutes East a distance of 135.45 feet to an iron pin; thence running South 1 degree 50 minutes West a distance of 100 feet to an iron pin; thence running North 88 degrees 10 minutes West a distance of 163.09 feet to an iron pin located on the east right of way of Ben Carter Highway; thence running North 17 degrees 17 minutes East a distance of 103.75 feet to the Point of Beginning. Being bound North by Southwoods Drive; East and South by other property of J.P. Morris; and West by Ben Carter Road. Reference is made to a survey by Denean W. Dixon, dated October 26, 1981, recorded in the Office of the Clerk of Superior Court of Appling County, Georgia.
This being the same property conveyed from Donnie H. Morris to Eugene Smith and Devora Jackson by deed dated February 2, 1990, recorded in Deed Book 245, Page 502, in the Office of the Clerk of Superior Court of Appling County, Georgia.

Said Deed to Secure Debt having been given to secure a note dated January 29, 2004 in the original principal amount of $30,189.00 with interest from date at the rate as specified therein
The debt secured by said Deed to Secure Debt has been and is hereby declared due because of among other possible events of default, failure to pay in accordance with the terms of said notes. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of the sale, including attorney's fees.

The above described property will be sold subject to unpaid state, county and city taxes to the highest bidder for cash and the proceeds will be applied to said indebtedness and the lawful expenses of said sale as provided in said security deed and a conveyance will be made to the purchaser at the sale as authorized by said security deed.
