Because of a default in the payment of the indebtedness secured by that certain Security Deed, dated May 25, 2006, executed by STACY S. HOWARD to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., recorded in Deed Book 417, Page 208, Appling County, Georgia Deed Records, and securing a Note in the original principal amount of $165,000.00, said Security Deed and Note last having been assigned to GREEN TREE SERVICING LLC, the current holder thereof, has declared the entire amount of said indebtedness evidenced by the Note immediately due and payable and, pursuant to the power of sale contained in said Security Deed, will, on the first Tuesday in May, 2011, to-wit: May 3, 2011, during the legal hours of sale, before the Appling County Courthouse door, sell at public outcry to the highest bidder for cash, the following described real property:
All that tract or parcel of land situate, lying and being in the City of Baxley, Appling County, Georgia, consisting of Lots Nos. I and 2 in Block No, 9, of what is known as Fendig's Addition to the City of Baxley, a subdivision, a plat of which is of record in office, Clerk of Superior Court, Appling County, Georgia, in Plat Book No. 1, page 7, reference to which is hereby made for all purposes. This property having the dimensions of 100 feet east and west and 145 feet north and south, and being bound. North by an alley; east by Thomas Street; south by Harvey Street, and west by Lot No. 3, Block 9, of said subdivision, being the tract or property conveyed from Mrs. J. C. Overstreet to John Lewis by deed dated July 30, 1940, recorded in Deed Book 47, page 139, of the deed records of Appling County, Georgia.
This property is the same as was conveyed from John D. Lewis, who is one and the same person as John Lewis, to M, L. Lewis, who is the same person as Michael L. Lewis, by deed dated February 24, 1966, recorded in Deed Book 122, page 170, as corrected by deed dated April 1, 1966, recorded in Deed Book 122, page 296, Appling County, Georgia, deed records.
All that tract or parcel of land lying and being in the town of Baxley, Appling County, Georgia, described according to a map of "Fendig's Addition to the Town of Baxley, Georgia", made by E. A, Penniman in March 1898, as all of Lot No. 3, Block 9, being the same and identical property conveyed by Stanley Land Company, to John Lewis, by deed dated April 14, 1941, recorded in Office, Clerk, Superior Court, Appling County, Georgia, at Deed Book 50, page 573.
This property is the same as was conveyed from John D. Lewis, who is the same person as John Lewis, to M. L. Lewis, who is the same person as Michael L. Lewis by deed recorded in deed book 152 page 624 of the deed records of Appling County, Georgia.
The afore-described real property is also known as 167 North Thomas Street, Baxley, Georgia 31513, according to the present system of numbering houses in Appling County, Georgia.
This sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit as to the amount and status of the loan with the holder of the Security Deed, including but not limited to, a determination that the borrower has not reinstated the loan prior to the foreclosure sale.
Said real property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the real property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
Upon information and belief, said real property is presently in the possession or control of STACY S. HOWARD and the proceeds of said sale will be applied to the payment of said indebtedness and all the expenses of said sale, including attorney's fees, all as provided in said Security Deed and the excess proceeds, if any, will be distributed as provided by law.
