On the 3rd day of March, 2008 Edward Dwayne Ussery and Ruby Juanita Armstrong of Appling County, Georgia, as Grantors, executed a Security Deed to Southeastern Bank, securing a promissory note of said date, said Security Deed having been recorded in the Office of the Clerk of Superior Court of Appling County, Georgia in Deed Book 442, Page 316.
By virtue of the Power of Sale contained in said Security Deed, there will be sold, by the undersigned at Public Outcry to the highest bidder for cash before the courthouse door of Appling County, Georgia, within the legal hours of sale on the First Tuesday in March, the same being March 5, 2013, the following property, to-wit:
All that certain tract or parcel of land lying, being and situate in Land Lot 332, Second Land District, City of Baxley, Appling County, Georgia, containing 0.095 acre, more or less. Said tract is more fully shown and described according to a plat of survey by M. Jerry Tomberlin, Jr., GRLS, entitled ?Survey For Dwyane Ussery, dated February 27, 2008, recorded in Plat Book 18, Page 628, Office of the Clerk of Superior Court, Appling County, Georgia; said plat and the description thereon are incorporated herein by reference for all intents and purposes. Said property is bounded, now or formerly, as follows: On the Northeast by the right-of-way of S. E. Park Avenue; On the Southeast by lands of J. W. & Jessie Murray; On the Southwest by the right-of-way of Crosby Street; and on the Northwest by the right-of-way of Fair Street;
Said conveyance includes all buildings and improvements located on said described property.
This is a portion of the same property described in that certain deed from Dan W. Miles to H. G. Miles, Jr. and James Allen Miles dated December, 1976, recorded in Deed Book 173, Page 85, public records of Appling County, Georgia; and is also a portion of the same property described as ?Tract 12? in that certain warranty deed from James Allen Miles, Sr., to Henry Grady Miles, Jr., dated August 14, 23002, recorded in Deed Book 364, Page 276, public records of said county.
James Allen Miles is the same person as James Allen Miles, Sr.; and H. G. Miles, Jr. is the same person as Henry Grady Miles, Jr.
The debt secured by said Security Deed and Note has been and is hereby declared due because of nonpayment thereof. The debt remaining in default, this sale is being made for the purposes of paying the same and all expenses of this sale and the proceeds of said sale will be applied as provided in said Security Deed.
To the best of the undersigned?s knowledge and belief, said property will be sold as the property of Edward Dwayne Ussery and Ruby Juanita Armstrong, subject to outstanding ad valorem taxes and/or easements and/or restrictive covenants appearing in the record, if any.
The undersigned will execute a Deed to the Purchaser at said sale, as provided in the aforesaid Security Deed.
