WHEREAS, there has been a default in the payment of the indebtedness secured by that certain Deed to Secure Debt, dated September 24, 2008, signed by Trinettea C. Lee and made to Altamaha Federal Credit Union and recorded in the Office of the Clerk of Appling County Superior Court in Deed Book, 450, pages 642-7; and
WHEREAS, to the best knowledge and belief of the undersigned said Trinettea C. Lee is in possession of the property conveyed by the aforesaid Deed to Secure Debt; and
WHEREAS, under the provisions of said Deed to Secure Debt the indebtedness secured thereby has immediately become due and payable and remains in default;
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That pursuant to the terms of said Deed to Secure Debt and the Power of Sale contained therein and the law in such cases made and provided after proper advertisement, the undersigned on the first Tuesday in December, 2012, before the Courthouse door in Appling County, Georgia, between the legal hours of sale, will expose for sale to the highest and best bidder for cash the following described property, to-wit:
All that certain tract or parcel of land situate, lying and being in Land Lot 340 in the Second Land District of Appling County, Georgia, containing 1.016 acres, as being more particularly shown on that certain plat prepared by Merlin J. Tomberlin, G.R.L.S. No. 2477, dated September 5, 2008, and recorded in the Office of the Clerk of Appling County Superior Court in Plat Book 19, folio 98. Reference is hereby made to said plat and the record thereof for all purposes of description.
TERMS: Cash; purchaser paying Georgia transfer tax and all ad valorem taxes and assessments that may be due on said property; the sale shall be subject to all superior liens, easements and restrictions of record, if any, and the right of redemption of any taxing authority; the proceeds of this sale shall be applied to pay the secured debt as provided in said Deed to Secure Debt together with the expenses of this sale, including attorney's fees.
