Mayor Steve Rigdon asked the manager if an escape clause could be added to the lease just in case the city needs the property. The manager stated that an escape clause could be added to the lease. After some discussion the council approved the recommendation to add an escape clause to the lease.
A public hearing date was set by the council for Feb. 21 at 6:00 p.m. on a petition for annexation filed by Greg Herrin to annex his property located at 533 Brandon Street to establish a Residential (R-15) zone.
The manager announced that the 2011 Annual Water Quality Report was ready and Water Department Superintendent Dale Sapp prepared the report. The manager commended Sapp on the great job that he did on the report. The city council members reviewed the report and it was approved. The manager stated the report will be made public and can be seen on the website. The mayor also thanked Sapp for the nice job of putting the report together.
The manager asked the council members to be considering someone that would like to serve as a board member on the Baxley/Appling County Housing Authority to replace board member Willie Ellis. Ellis has an unexpired term and has requested to come off the board.
Mayor Pro Tem Esco Hall, Jr. reported that he attended a development authority meeting on Monday, Jan. 23 and stated the meeting was encouraging. He also reminded the council that the voting on ESPLOST would be held March 6.
Hall stated Rickey Jackson is deceased and he was the petitioner for an annexation for property on 43 Harry Street. He asked how this would be handled since the petitioner is now deceased. City Attorney Alex Johnson advised that the petition would still go through as long as the right titleholder, such as the spouse’s name, is on the petition.
The council approved a first reading for an ordinance annexing property owned by Bonnie Beecher located at 473 Palmetto Circle and establishing a Residential (R-20) zone.
City manager report
The city manager reported that Phase III of the CDBG project is going well.
The manager stated they had three public hearings scheduled for Feb. 7. The petition for annexation for Mary Lee Wilkerson has been withdrawn, leaving only two.
Manager Baxley announced the bids on the airport project would be opened at 11:00 a.m. on Thursday, Jan. 26.
The manager reported that the city has submitted the application for re-certification as a City of Ethics. He received notice from GMA that the City of Ethics designation will be awarded in June at the GMA convention.
City Attorney Alex Johnson asked about the status of the TEA project. The manager explained that the city has been awarded $250,000.00 for sidewalk improvements on the south side of Tippins Street and the medium area in front of Lewis Battery and Electric. Johnson stated there have been some legal issues concerning the sidewalk on Tippins Street and hopes to have this resolved soon.
